Senator KOVACIC: What is ACARA's contractual service-level agreement with Education Services Australia for platform uptime and incident response time? Can you tell us whether that agreement was breached or not. If it was breached, what have been the consequences for ESA? Mr Gniel: Yes. We do have a service-level agreement, as you mentioned. I'm happy to get you the detail of the times and those things that are in there, but, yes, I think it's safe to say that they weren't met and that there were breaches of that agreement. I think part of that is about us working in partnership with another Commonwealth agency-a company that is funded by the same group that we work with, to work together on responding to that. But I'm happy to get you the detail on the specifics of the performance requirements for the platform. Senator KOVACIC: Could you also let me know the consequences-if there are any-for ESA, financial or otherwise, as a result of not meeting those. Mr Gniel: Yes-can do. Senator KOVACIC: Thank you. Are you able to table the relevant contract or service agreement? Mr Gniel: I'm happy to get some advice on that. Because we're dealing with not only a statutory authority but a company as well, I'll just have to check the legality- Senator KOVACIC: If you can provide elements that take away anything that might compromise, commercially, but that might give us an insight into the type of information we're seeking, I'd be comfortable with that as well. Mr Gniel: Great. Thank you.
