Combatting Antisemitism, Hate and Extremism Act 2026
Question
1. Two organisations have now been listed as prohibited hate groups under the new framework. What criteria did the Attorney-General apply in determining the order of listings, and what role did the Department play in the assessment process? 2. Are there other organisations currently under active consideration for listing? Without compromising operational sensitivities, can the Department outline the expected timeline and pipeline for further listings? 3. What policy guidance has the Department issued to the CDPP on prosecuting offences under the new prohibited hate group provisions, including membership, recruitment and material support offences? 4. Has the CDPP received any briefs of evidence from the AFP relating to offences under the prohibited hate group framework since the Hizb ut-Tahrir listing came into effect on 6 March 2026? If so, how many, and what is the status of each? 5. Has the CDPP received any briefs of evidence relating to offences connected to the listing of the group "White Australia" since it came into effect on 16 May 2026? If so, how many, and what is the status of each? 6. It is now nearly three months since Hizb ut-Tahrir was listed. If no individuals have been charged with offences under Division 114B in connection with that listing, what is the practical effect of the listing to date? 7. Has the Department received any reports indicating that Hizb ut-Tahrir is continuing to operate under a different name or through successor entities? Does the framework adequately deal with successor organisations, or is there a legislative gap?
